However, we do not warrant that product descriptions or other content on the Site are 100% accurate, complete, reliable, current, or error-free. If a product offered by Amanah Essentials is not as described, your sole remedy is to return it in unused condition as per our Refund and Replacement Policy.

All pricing and availability information is subject to change without notice. We reserve the right to refuse or cancel an order for any reason, including limitations on quantities available for purchase, inaccuracies, or errors in product or pricing information.

3.4. Delivery
Delivery times are estimates only. We are not liable for any delays in delivery that are beyond our control. Risk of loss and title for items purchased from the Site pass to you upon delivery of the items to the carrier.
4. Payments and Refunds
4.1. Payment Methods
We accept various forms of payment, including Cash on Delivery (COD), Mobile Financial Services (MFS), and Credit/Debit Cards. You agree to provide valid and accurate payment information.
4.2. Advance Payment
In accordance with Bangladesh’s e-commerce guidelines, we may require partial or full advance payment for certain non-ready-stock items or high-value orders.
4.3. Refunds
All refunds, returns, and replacements are governed by our separate Product Refund and Replacement Policy, which is incorporated into these Terms by reference. We are committed to processing refunds within the legally mandated timeframes upon successful product inspection.
5. Prohibited Activities
You may not access or use the Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by us.
Prohibited activities include, but are not limited to:
· Attempting to bypass or circumvent any security features of the Site.

The Site and all products delivered to you through the Site are provided on an “as is” and “as available” basis, without any warranties or conditions, express or implied, except as expressly stated in our policies (e.g., Refund and Replacement Policy).
7.2. Limitation of Damages
To the fullest extent permitted by applicable law, Amanah Essentials shall not be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits or data, arising out of your use of the Site or any products purchased therefrom, even if we have been advised of the possibility of such damages. In no event shall our total liability to you for all damages exceed the amount paid by you for the product(s) in question.
8. Governing Law and Dispute Resolution
These Terms of Use shall be governed by and construed in accordance with the laws of the People’s Republic of Bangladesh.
Any dispute, controversy, or claim arising out of or relating to these Terms of Use, the breach, termination, or invalidity thereof, shall be settled exclusively by the competent courts of Bangladesh.

আমানাহ এসেনশিয়ালস এর ওয়েবসাইটে [https://amanahessentials.com/] এবং এর সাথে সম্পর্কিত যেকোনো মোবাইল অ্যাপ্লিকেশন (সম্মিলিতভাবে “সাইট”) অ্যাক্সেস বা ব্যবহার করার আগে দয়া করে এই ব্যবহারের শর্তাবলী মনোযোগ সহকারে পড়ুন।

১.২. বয়স এবং যোগ্যতা
সাইটটি ব্যবহার করার মাধ্যমে, আপনি প্রতিনিধিত্ব করছেন যে আপনার বয়স কমপক্ষে ১৮ বছর বা আপনি একজন অভিভাবক বা আইনি অভিভাবকের তত্ত্বাবধানে সাইটটি ব্যবহার করছেন, যিনি এই শর্তাবলী দ্বারা আবদ্ধ হতে সম্মত।

২.২. তথ্যের যথার্থতা
আপনি বর্তমান, সম্পূর্ণ এবং নির্ভুল নিবন্ধনের তথ্য সরবরাহ করতে এবং পরিবর্তিত যেকোনো তথ্য অবিলম্বে হালনাগাদ করতে সম্মত। আপনি যদি এমন কোনো তথ্য সরবরাহ করেন যা অসত্য, ভুল, বর্তমান নয় বা অসম্পূর্ণ, তাহলে আপনার অ্যাকাউন্ট স্থগিত বা বাতিল করার এবং সাইটের যেকোনো বর্তমান বা ভবিষ্যতের ব্যবহার অস্বীকার করার অধিকার আমাদের রয়েছে।
২.৩. অ্যাকাউন্ট বাতিলকরণ
এই ব্যবহারের শর্তাবলীর যেকোনো একটি লঙ্ঘন করলে সহ যেকোনো কারণে, পূর্বের কোনো বিজ্ঞপ্তি ছাড়াই আমরা যেকোনো সময় আপনার অ্যাকাউন্ট স্থগিত বা বাতিল করার অধিকার সংরক্ষণ করি।
৩। পণ্য এবং অর্ডার
৩.১. পণ্যের বর্ণনা
আমরা পণ্যের বর্ণনা, ছবি এবং মূল্য নির্ধারণে যতটা সম্ভব নির্ভুল হওয়ার চেষ্টা করি। তবে, আমরা নিশ্চয়তা দিই না যে সাইটে পণ্যের বর্ণনা বা অন্যান্য বিষয়বস্তু ১০০% নির্ভুল, সম্পূর্ণ, নির্ভরযোগ্য, বর্তমান বা ত্রুটিমুক্ত। আমানাহ এসেনশিয়ালস দ্বারা অফার করা কোনো পণ্য যদি বর্ণনার মতো না হয়, তবে আপনার একমাত্র প্রতিকার হলো আমাদের ফেরত ও প্রতিস্থাপন নীতি (Refund and Replacement Policy) অনুসারে অব্যবহৃত অবস্থায় তা ফেরত দেওয়া।
৩.২. মূল্য নির্ধারণ এবং প্রাপ্যতা
সমস্ত মূল্য নির্ধারণ এবং প্রাপ্যতার তথ্য পূর্ব বিজ্ঞপ্তি ছাড়াই পরিবর্তন সাপেক্ষ। আমরা ক্রয়ের জন্য উপলব্ধ পরিমাণের উপর সীমাবদ্ধতা, ভুল তথ্য বা মূল্য নির্ধারণের ত্রুটি সহ যেকোনো কারণে একটি অর্ডার প্রত্যাখ্যান বা বাতিল করার অধিকার সংরক্ষণ করি।
৩.৩. অর্ডার গ্রহণ
আপনার একটি ইলেকট্রনিক বা অন্য কোনো ধরনের অর্ডার নিশ্চিতকরণ প্রাপ্তি মানে আপনার অর্ডারটি আমাদের চূড়ান্তভাবে গ্রহণ করা হয়েছে এমন নয়। আপনার অর্ডার পাওয়ার পরে যেকোনো সময় যেকোনো কারণে আপনার অর্ডার গ্রহণ বা প্রত্যাখ্যান করার অধিকার আমরা সংরক্ষণ করি।
৩.৪. ডেলিভারি
ডেলিভারির সময় কেবল আনুমানিক। আমাদের নিয়ন্ত্রণের বাইরের কোনো কারণে ডেলিভারিতে বিলম্বের জন্য আমরা দায়ী নই। সাইট থেকে কেনা আইটেমগুলির ক্ষতি হওয়ার ঝুঁকি এবং স্বত্ব পণ্যগুলি বাহকের কাছে হস্তান্তর করার সাথে সাথেই আপনার কাছে স্থানান্তরিত হয়।
৪। অর্থপ্রদান এবং মূল্য ফেরত
৪.১. অর্থপ্রদানের পদ্ধতি
আমরা ক্যাশ অন ডেলিভারি (COD), মোবাইল ফিনান্সিয়াল সার্ভিসেস (MFS), এবং ক্রেডিট/ডেবিট কার্ড সহ বিভিন্ন ধরনের অর্থপ্রদানের পদ্ধতি গ্রহণ করি। আপনি বৈধ এবং নির্ভুল অর্থপ্রদানের তথ্য সরবরাহ করতে সম্মত।
৪.২. অগ্রিম অর্থপ্রদান
বাংলাদেশের ই-কমার্স নির্দেশিকা অনুসারে, আমরা নির্দিষ্ট কিছু নন-রেডি-স্টক আইটেম বা উচ্চ-মূল্যের অর্ডারের জন্য আংশিক বা সম্পূর্ণ অগ্রিম অর্থপ্রদানের শর্ত আরোপ করতে পারি।
৪.৩. মূল্য ফেরত
সমস্ত মূল্য ফেরত, রিটার্ন এবং প্রতিস্থাপন আমাদের পৃথক পণ্য ফেরত ও প্রতিস্থাপন নীতি দ্বারা নিয়ন্ত্রিত হয়, যা রেফারেন্স দ্বারা এই শর্তাবলীতে অন্তর্ভুক্ত করা হয়েছে। সফল পণ্য পরিদর্শনের পরে আইনিভাবে নির্ধারিত সময়সীমার মধ্যে মূল্য ফেরত প্রক্রিয়া করতে আমরা অঙ্গীকারবদ্ধ।
৫। নিষিদ্ধ কার্যকলাপ
আমরা যে উদ্দেশ্যে সাইটটি উপলব্ধ করি, তা ব্যতীত অন্য কোনো উদ্দেশ্যে আপনি সাইটটি অ্যাক্সেস বা ব্যবহার করতে পারবেন না। আমাদের দ্বারা বিশেষভাবে অনুমোদিত বা অনুমোদিত না হলে, সাইটটি কোনো বাণিজ্যিক উদ্যোগের সাথে ব্যবহার করা যাবে না।
নিষিদ্ধ কার্যকলাপের মধ্যে রয়েছে, তবে এতেই সীমাবদ্ধ নয়:

· আমাদের পূর্ব লিখিত সম্মতি ছাড়া পণ্য ও পরিষেবা বিজ্ঞাপন বা বিক্রয়ের প্রস্তাব দেওয়ার জন্য সাইটটি ব্যবহার করা।
· মানহানিকর, আপত্তিজনক, অশ্লীল বা অন্যথায় আপত্তিকর সামগ্রী পোস্ট বা প্রেরণ করা।
৬। মেধা সম্পত্তির অধিকার
৬.১. মালিকানা
সাইটের সমস্ত বিষয়বস্তু, যার মধ্যে টেক্সট, গ্রাফিক্স, লোগো, ছবি, অডিও, ভিডিও, সফটওয়্যার এবং এই ধরনের বিষয়বস্তুর সংকলন (সম্মিলিতভাবে, “বিষয়বস্তু“), আমানাহ এসেনশিয়ালস বা এর সরবরাহকারীদের সম্পত্তি এবং এটি বাংলাদেশের এবং আন্তর্জাতিক কপিরাইট, ট্রেডমার্ক এবং অন্যান্য মেধা সম্পত্তির আইন দ্বারা সুরক্ষিত।
৬.২. সীমিত লাইসেন্স
আমরা আপনাকে সাইটটিতে বিক্রি হওয়া আইটেমগুলির কেনাকাটার মতো ব্যক্তিগত, অ-বাণিজ্যিক ব্যবহারের জন্য সাইটটি অ্যাক্সেস এবং ব্যবহার করার জন্য একটি সীমিত, অ-একচেটিয়া, হস্তান্তর অযোগ্য এবং প্রত্যাহারযোগ্য লাইসেন্স প্রদান করি। আমাদের স্পষ্ট লিখিত অনুমতি ছাড়া কোনো বাণিজ্যিক ব্যবহার বা কোনো তৃতীয় পক্ষের পক্ষ থেকে ব্যবহার নিষিদ্ধ।
৭। দায়বদ্ধতার সীমাবদ্ধতা
৭.১. ওয়ারেন্টি অস্বীকার

৭.২. ক্ষতির সীমাবদ্ধতা
প্রযোজ্য আইন দ্বারা অনুমোদিত সম্পূর্ণ পরিমাণে, আমানাহ এসেনশিয়ালস সাইটের আপনার ব্যবহার বা সেখান থেকে কেনা যেকোনো পণ্য থেকে উদ্ভূত কোনো পরোক্ষ, আনুষঙ্গিক, শাস্তিমূলক, বিশেষ, বা ফলস্বরূপ ক্ষতির জন্য, যার মধ্যে লাভ বা ডেটার ক্ষতি অন্তর্ভুক্ত, তার জন্য দায়ী থাকবে না, এমনকি যদি আমাদের এই ধরনের ক্ষতির সম্ভাবনার বিষয়ে পরামর্শ দেওয়া হয়। কোনো অবস্থাতেই সমস্ত ক্ষতির জন্য আপনার কাছে আমাদের মোট দায়বদ্ধতা প্রশ্নযুক্ত পণ্য(গুলি) এর জন্য আপনার দ্বারা পরিশোধিত পরিমাণের বেশি হবে না।
৮। নিয়ন্ত্রক আইন এবং বিরোধ নিষ্পত্তি
এই ব্যবহারের শর্তাবলী গণপ্রজাতন্ত্রী বাংলাদেশের আইন দ্বারা নিয়ন্ত্রিত হবে এবং সেই অনুযায়ী ব্যাখ্যা করা হবে।
এই ব্যবহারের শর্তাবলী, এর লঙ্ঘন, বাতিল বা অবৈধতা থেকে উদ্ভূত বা সম্পর্কিত যেকোনো বিরোধ, বিতর্ক বা দাবি বাংলাদেশের উপযুক্ত আদালতের মাধ্যমে নিষ্পত্তি করা হবে।
৯। যোগাযোগ এবং সমর্থন
একটি অ্যাকাউন্ট তৈরি করার মাধ্যমে, আপনি আমাদের কাছ থেকে বিপণন সামগ্রী, নিউজলেটার, অ্যাকাউন্ট নোটিফিকেশন এবং প্রচারমূলক অফার সহ ইলেকট্রনিক যোগাযোগ গ্রহণ করতে সম্মত। আপনি ইমেইলের “সাবস্ক্রাইব বাতিল করুন” (“unsubscribe”) লিঙ্কে ক্লিক করে বিপণন ইমেল গ্রহণ করা থেকে অপ্ট আউট করতে পারেন।
